What are my rights to a meal break in California?.

 

Answer

California law requires employers to provide meal periods of at least 30 minutes for every five hours worked, with some exceptions.

Employers are not required to police meal breaks.  You are responsible for making sure you take your thirty-minute meal break.

The employer must relieve you of all job duties during your meal period.  If you work during the break they must pay you for that time.

Your employer cannot discourage or impede you from taking breaks.

If an employer fails to provide a compliant meal period, they must pay you one hour’s pay for every missed or non-compliant meal period.
